VICTIM COMPENSATION

Section 357A(I) of the Code of Criminal Procedure provides that every State Government in co-ordination with the Central Government Shall prepare a scheme for providing funds for the purpose of compensation to the victim or his dependents who have suffered loss or injury as a result of the crime and who require rehabilitation. In accordance thereof, the Government of Assam has formulated the Assam Victim Compensation Scheme 2012. Under the aforesaid Scheme, the State Legal Services Authority and the District Legal Services Authorities are assigned with the duty of providing compensation to the victims and their dependents after proper enquiry and verification. Any person eligible under the said scheme may directly make an application to the legal services authority for grant of victim compensation in accordance with clause 5 of the said Scheme.

In addition to the above Scheme, the National Legal Services Authority under the direction of Hon’ble Supreme Court of Indian in W.P (C) No. 565/2012 titled Nipun Saxena Vs Union of India had formulated another victim compensation scheme, namely, Compensation Scheme for Women Victims/Survivors of Sexual Assault/ Other Crimes” 2018. This scheme basically aims at providing compensation to the victim of sexual offences, acid attacks, and women victims of other crimes.
